Mistakes to avoid
- Waiting until 30 days before a visa expiration to begin renewal — H-1B premium processing takes 15 days but petition preparation, LCA prevailing wage determination, and internal approvals take 60-90 days; starting at 30 days is too late
- Misunderstanding the grace period — an H-1B employee who is laid off and doesn't leave or change status within 60 days is accruing unlawful presence, which triggers a 3-year bar to re-entry if they later apply for immigration benefits
- Not tracking STEM OPT students' unemployment days in real-time — the unemployment clock runs continuously and resets only when the employee changes to a different status (H-1B, etc.); a student who thinks they have "30 days left" may have already exceeded the limit without realizing it
- Filing I-485 before checking the priority date — if the priority date is not current (not yet reached the filing date for the category), the I-485 cannot be filed; this wastes the filing fee and creates processing delays
