Mistakes to avoid
- Completing Section 2 of the I-9 before Section 1 is completed by the employee — Section 1 is the employee's attestation; it must come first
- Accepting documents that appear on their face to be valid but don't actually belong to the employee — always compare the photo to the person, and the name and DOB on the document to the I-9 form
- Forgetting to reverify EAD (Employment Authorization Document) before it expires — the employee is not authorized to work after the EAD expiration date; having a calendar reminder 90 days before expiration is non-negotiable
- Failing to post the LCA public access file — this is one of the most commonly overlooked H-1B requirements and is a straightforward DOL violation
- Not tracking LCA validity dates — an LCA is valid for the period specified on the form (typically 3 years); continuing to employ someone under an expired LCA is a violation
