Errores que conviene evitar
- Tracking the visa expiration date instead of the I-94 expiration date — these can be different; the I-94 is the authoritative record of how long a person is authorized to stay in the US; the visa stamp in the passport only determines whether they can ENTER the US; a person can have a valid visa but an expired I-94 and be out of status
- Forgetting the 60-day grace period for H-1B/L-1 employees who are terminated — when employment ends, the employee has 60 days or the end of their validity period (whichever is shorter) to either leave, change status, or file a new petition; this is not a vacation period and cannot be extended
- Not tracking the maximum stay limits for L-1 and O-1 employees — these cannot be extended beyond the statutory maximum regardless of employer preference; a manager who doesn't know their L-1 employee is in year 6 of 7 will be very surprised when the extension is denied
- Telling an LPR they can "just travel" without understanding the 6-month rule — a green card holder who spends 9 months abroad and returns will be questioned by CBP at the border; some are admitted; some are not; re-entry permits should be applied for before departure for absences > 6 months
